Restitution as a Requirement for the Implementation of Restorative Justice Against General Crimes Related to Property

Restitution is a monetary remedy paid by perpetrator or third party to victim their family. It can be implemented returning property, payment for losses suffering, reimbursement of costs. However, restitution not applicable all types crimes; thus, victims have access it.The issue legal protection still an ongoing discourse, and many parties believe that its implementation far from perfect in need reform due the inability perpetrators pay victims. This study uses qualitative methods examining secondary data such as documents, laws regulations, scientific findings, books. finds application restorative justice criminal cases, especially property crimes provides certain flexibility community search settlement. The paying absolute requirement settlement property-related crime alternative conventional court proceeding. Moreover, perpetrators, victims, involved discussion process reach consensus regarding solution conflict avoiding harming any parties, instance, without punishment.
